These Terms and Conditions set out the agreement between Waste Disposal Wimbledon, referred to as we, us or our, and the customer, referred to as you or your, for the provision of waste collection and disposal services. By booking or using our services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Service means any waste collection, removal, transportation, clearance, recycling or disposal activity that we provide to you.
Booking means a request made by you for us to provide a Service, whether by telephone, email, online form or any other method accepted by us.
Waste means any items, materials, goods, rubbish or refuse you ask us to remove, including household, commercial, garden, bulky or mixed waste, but excluding any prohibited or hazardous items set out in these Terms.
Working Day means any day other than a Saturday, Sunday or public holiday in England.
We primarily provide waste collection and disposal services to customers in and around Wimbledon and surrounding local areas. Service availability may vary depending on your specific location, access, property type and the nature of the Waste to be collected.
We reserve the right to decline a Booking or cancel a Service where we reasonably believe that access is unsafe or impractical, where your Waste does not comply with these Terms, or where providing the Service would breach applicable laws or regulations.
You may request a Booking for our waste collection services by contacting us through our accepted communication channels. You must provide accurate and complete information, including your contact details, collection address, a description and approximate volume of Waste, preferred dates and times, and any relevant access details.
Based on the information you provide, we may offer an estimated price or a price range for the Service. Any estimate is given in good faith but does not constitute a fixed quotation until confirmed by us. We may need to inspect the Waste in person or on arrival to confirm the final price before commencing work.
A Booking is only accepted, and a contract between you and us formed, when we confirm the Booking and, where required, you have paid any deposit or prepayment requested. We may confirm Bookings verbally, by email, in writing or by electronic message.
You are responsible for ensuring that all details in the Booking confirmation are correct. If you notice any errors, you must contact us immediately so that we can review and, where possible, amend the Booking.
You must ensure that our team has safe, reasonable and timely access to the collection point at the agreed time. This includes providing accurate directions, entry codes or details of any parking restrictions. You must secure any necessary permissions for access to shared spaces, private roads or restricted areas in advance of the Service.
You are responsible for ensuring that the Waste to be collected is clearly identified and accessible. Unless we have agreed to provide a clearance service within your premises, Waste should be placed in an accessible area such as a driveway, front garden or designated collection point.
If access is delayed, obstructed or unsafe, we may at our discretion charge additional waiting time, rearrange the Booking, or cancel the Service and charge a cancellation fee in accordance with these Terms.
We collect most common types of household and commercial Waste, including general rubbish, recyclable materials, furniture, appliances and garden Waste, subject to applicable regulations and facility acceptance.
You must not present for collection any hazardous, prohibited or regulated items without our prior written agreement. These may include, but are not limited to, asbestos, chemicals, solvents, oils, fuel, medical or clinical Waste, pressurised containers, explosives, gas bottles, certain electrical items, paint, tyres or any item classified as hazardous or special Waste under current regulations.
We reserve the right to refuse to collect any Waste that we reasonably believe to be hazardous, unsafe, incorrectly described, excessively heavy, contaminated or otherwise unsuitable for collection or disposal through our usual facilities. If such items are discovered during collection, we may remove only the acceptable Waste and adjust the price accordingly, or cancel the Service and charge for any time and costs incurred.
Prices for our waste collection services are generally based on factors including estimated or actual volume of Waste, weight, type of materials, labour time required, access conditions, distance, disposal or recycling charges, and any additional services requested.
Any quotation we provide prior to viewing the Waste is an estimate only and may be varied on site once our team has assessed the actual volume, type and condition of the Waste, as well as the access and labour required. If the final price differs from the original estimate, we will notify you before commencing work. If you do not accept the revised price, we may cancel the Service and reserve the right to charge a call-out or cancellation fee to cover our time and costs.
All prices are stated in pounds sterling and are exclusive or inclusive of VAT as specified at the time of quotation. Where applicable, VAT will be charged at the prevailing rate.
Unless otherwise agreed in writing, payment for our services is due immediately upon completion of the collection, or in advance where required. We may request a deposit or full prepayment for certain Bookings, particularly for larger volumes, commercial clearances or specialist Waste.
We accept payment by methods notified to you at the time of Booking, which may include cash, card or bank transfer. You must ensure that funds are available and that any card or account used belongs to you or that you have authority to use it.
For approved business customers with credit terms, payment must be made by the due date stated on the invoice. If no date is specified, payment is due within 30 days of the invoice date. We reserve the right to charge interest and reasonable recovery costs on late payments in accordance with applicable law.
You may cancel or amend a Booking by contacting us as soon as possible before the agreed collection time. Any cancellation or amendment is only effective when acknowledged by us.
If you cancel a Booking more than 24 hours before the scheduled collection time, we will normally cancel without charge, unless we have incurred specific costs that cannot be recovered. If you cancel within 24 hours of the collection time, or if our team attends but is unable to complete the Service due to your act or omission, we may charge a cancellation or call-out fee to cover our reasonable costs and lost capacity.
If you wish to change the date, time, location or scope of the Service, we will use reasonable efforts to accommodate your request, but we cannot guarantee availability. Changes may affect the price, and we will notify you of any adjustments before proceeding.
We aim to provide reliable waste collection services, but we may occasionally need to cancel, postpone or amend a Booking due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, staff illness, access issues, safety concerns or regulatory restrictions.
Where reasonably possible, we will notify you of any changes as soon as practicable and offer an alternative date or time. We will not be liable for any indirect or consequential losses arising from such changes, but if we cancel a Service without providing an alternative, and you have made a payment in advance, we will refund that payment for the affected Service.
Any collection time or arrival window given at the time of Booking is an estimate only and is not guaranteed, although we will use reasonable endeavours to attend within the agreed period. Factors such as traffic, access difficulties, previous jobs and operational issues may cause delays.
You must ensure that you or an authorised representative is available at the property during the collection window, if required, to grant access, identify Waste or approve any revised pricing. If no one is available and we cannot complete the Service, this may be treated as a late cancellation, and we may charge a fee accordingly.
Once we have collected the Waste and payment is made or agreed in accordance with these Terms, title to the Waste transfers to us and we become responsible for its subsequent handling, treatment, recycling or disposal in accordance with applicable laws and regulations.
We operate as a licensed waste carrier and will use authorised facilities for the treatment, recycling, recovery or disposal of Waste. We aim to minimise the amount of Waste sent to landfill where reasonably practicable and in line with local waste management policies and facility availability.
You warrant that you are the owner of the Waste or that you have full authority from the owner to arrange for its removal and disposal. You also warrant that the Waste does not contain any hazardous, dangerous or prohibited materials that you have not disclosed in writing.
You agree to indemnify and keep us indemnified against any claims, losses, damages, costs or expenses arising from a breach of these warranties, including any incorrect description of Waste, unauthorised disposal of third-party property, or inclusion of hazardous items contrary to these Terms.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other matter that cannot be excluded or limited under applicable law.
Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the provision of our services shall be limited to the total price paid or payable by you for the specific Service giving rise to the claim.
We shall not be liable for any indirect, special or consequential loss, loss of profit, loss of business, loss of opportunity or loss of data, whether arising in contract, tort or otherwise. We are not responsible for any damage to property where such damage arises from pre-existing defects, structural weaknesses, inadequate access, or where you have requested or insisted on a method of collection that is not recommended by us.
You must report any alleged damage or loss caused by our team in writing as soon as reasonably possible and, in any event, within 48 hours of completion of the Service, providing reasonable details. We may require access to inspect the alleged damage before any remedial action is agreed.
We operate in accordance with applicable UK waste management legislation and local regulations, including duties relating to waste carriers, transfer notes, controlled Waste, recycling, recovery and disposal. By using our services, you acknowledge that we may be required to record certain information about the Waste collected and its source for regulatory purposes.
You agree to cooperate with any reasonable requests from us necessary to comply with legal obligations, including providing accurate descriptions of Waste and any information required for documentation. You must not request or encourage us to dispose of Waste in any unlawful manner.
We shall not be in breach of these Terms or liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. Such events may include, without limitation, extreme weather, natural disasters, strikes, lock-outs, industrial disputes, accidents, equipment failure, fuel shortages, road closures, public health restrictions, acts of government or regulatory authorities, or acts of third parties.
We will collect and process personal information about you for the purpose of managing your Booking, providing services, handling payments, and communicating with you. We will handle your personal data in accordance with applicable data protection laws and our privacy practices.
We may retain records of Bookings and Waste collections as required by law and for legitimate business purposes such as accounting, service improvement and dispute resolution.
We may update or amend these Terms from time to time to reflect changes in our services, operational practices, pricing structures, or applicable laws and regulations. Any updated Terms will apply to new Bookings from the date of publication or notification.
The Terms in force at the time of your Booking will govern that Booking, unless a change is required by law or mutually agreed in writing.
If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be interpreted, limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms and any dispute or claim arising out of or in connection with them, or the provision of our waste collection and disposal services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
If you have any questions about these Terms or about our waste collection services, or if you wish to make a complaint, you should contact us using the communication details provided to you at the time of Booking or on our customer documentation. We will aim to respond to any queries or complaints within a reasonable timeframe.
